Enforcement Decree of the Special Act on the Safety and Maintenance of Facilities, Article 37 (Scale of Accidents and Damage, etc.|9)
① 법 제58조제1항에서 "대통령령으로 정하는 규모 이상의 사고"란 다음 각 호의 어느 하나에 해당하는 피해가 발생한 사고를 말한다.
(1) The term "accidents of a scale prescribed by Presidential Decree or larger" in Article 58 (1) of the Act means accidents in which damage falling under any of the following occurred:
1. 시설물이 붕괴되거나 쓰러지는 등의 시설물피해
1. Facility damage such as collapse or overturning of a facility;
2. 사망자 또는 실종자가 1명 이상이거나 부상자가 5명 이상인 인명피해
2. Casualties in which at least one person died or went missing or at least five persons were injured;
3. 그 밖에 국토교통부장관이 조사가 필요하다고 정하여 고시하는 시설물피해 또는 인명피해
3. Other facility damage or casualties that the Minister of Land, Infrastructure and Transport determines and publicly notifies as requiring investigation.
② 법 제58조제4항에서 "대통령령으로 정하는 규모 이상의 피해"란 다음 각 호의 어느 하나에 해당하는 피해를 말한다.
(2) The term "damage of a scale prescribed by Presidential Decree or larger" in Article 58 (4) of the Act means damage falling under any of the following:
1. 시설물이 붕괴되거나 쓰러지는 등의 시설물피해
1. Facility damage such as collapse or overturning of a facility;
2. 사망자 또는 실종자가 1명 이상이거나 부상자가 10명 이상인 인명피해
2. Casualties in which at least one person died or went missing or at least 10 persons were injured;
3. 그 밖에 국토교통부장관이 조사가 필요하다고 인정하는 시설물피해 또는 인명피해
3. Other facility damage or casualties that the Minister of Land, Infrastructure and Transport recognizes as requiring investigation.
③ 부상자가 5명 이상 9명 이하인 인명피해가 발생한 시설물의 사고조사 등을 위하여 법 제58조제5항에 따른 시설물사고조사위원회(이하 "시설물사고조사위원회"라 한다)를 구성ㆍ운영하는 경우에는 법 제6조제4항 및 제6항에 따라 해당 시설물의 시설물관리계획을 보고받은 중앙행정기관의 장 또는 지방자치단체의 장이 해당 시설물사고조사위원회를 구성ㆍ운영한다.
(3) When a Facility Accident Investigation Committee under Article 58 (5) of the Act (hereinafter referred to as the "Facility Accident Investigation Committee") is to be organized and operated for investigating an accident, etc. of a facility in which casualties of at least five and no more than nine injured persons occurred, the head of the central administrative agency or the head of the local government who received the facility management plan of that facility pursuant to Article 6 (4) and (6) of the Act shall organize and operate that Facility Accident Investigation Committee.
