식품산업진흥법 시행령 제31조(원산지인증의 절차)

① 법 제22조의2제1항에 따라 원산지인증을 받으려는 경우에는 가공식품을 생산하는 사업자는 품목별로, 음식점등(「식품위생법」 제36조제1항제3호에 따른 식품접객업 및 같은 법 제2조제12호에 따른 집단급식소를 말한다. 이하 같다)의 영업자는 영업의 종류별로 농림축산식품부령으로 정하는 인증신청서를 다음 각 호의 구분에 따라 우수식품등인증기관의 장에게 제출해야 한다. <개정 2019.6.25, 2021.2.19>

② 우수식품등인증기관의 장은 제1항제1호 및 제3호에 따라 신청서를 받은 때에는 농림축산식품부령으로 정하는 인증의 심사방법에 따라 심사하여 제32조제1항에 따른 인증기준에 적합한 경우 원산지인증을 하여야 한다. <개정 2019.6.25, 2021.2.19>

③ 우수식품등인증기관의 장은 제2항에 따라 원산지인증을 하였을 때에는 농림축산식품부령으로 정하는 바에 따라 인증서를 내주어야 한다. <개정 2019.6.25, 2021.2.19>

④ 제1항제2호 및 제3호에 따라 우수수산식품등인증기관의 장에게 원산지인증을 신청한 경우 그 원산지인증의 심사 방법ㆍ절차 등은 「수산식품산업의 육성 및 지원에 관한 법률 시행령」 제33조에 따른다. <신설 2021.2.19>
