신탁법 제66조(수익권에 대한 질권)

① 수익자는 수익권을 질권의 목적으로 할 수 있다. 다만, 수익권의 성질이 질권의 설정을 허용하지 아니하는 경우에는 그러하지 아니하다.

② 제1항에도 불구하고 수익권을 목적으로 하는 질권의 설정에 대하여 신탁행위로 달리 정한 경우에는 그에 따른다. 다만, 그 정함으로써 선의의 제3자에게 대항하지 못한다.

③ 수익권을 목적으로 하는 질권의 설정에 관하여는 수익권 양도의 대항요건과 수탁자의 항변사유에 관한 제65조를 준용한다. 이 경우 제65조 중 "양도인"은 "수익자"로, "양수인"은 "질권자"로 보고, 같은 조 제1항 중 "수익권의 양수 사실"은 "수익권에 대하여 질권이 설정된 사실"로 본다.

④ 수익권을 목적으로 하는 질권은 그 수익권에 기한 수익채권과 이 법 또는 신탁행위에 따라 그 수익권을 갈음하여 수익자가 받을 금전이나 그 밖의 재산에도 존재한다.

⑤ 수익권의 질권자는 직접 수탁자로부터 금전을 지급받아 다른 채권자에 우선하여 자기 채권의 변제에 충당할 수 있다.

⑥ 질권자의 채권이 변제기에 이르지 아니한 경우 질권자는 수탁자에게 그 변제금액의 공탁을 청구할 수 있다. 이 경우 질권은 그 공탁금에 존재한다.
