신탁법 제97조(분할의 효과)

① 제94조에 따라 분할되는 신탁재산에 속한 권리ㆍ의무는 분할계획서 또는 분할합병계획서가 정하는 바에 따라 분할 후 신설신탁 또는 분할합병신탁에 존속한다.

② 수탁자는 분할하는 신탁재산의 채권자에게 분할된 신탁과 분할 후의 신설신탁 또는 분할합병신탁의 신탁재산으로 변제할 책임이 있다.
