액화석유가스의 안전관리 및 사업법 시행규칙 제72조의4(액화석유가스배관 매설상황 확인 등)

① 굴착공사자는 법 제49조의3제1항에 따라 액화석유가스배관이 묻혀 있는지에 관해 영 제21조의2에 따라 위탁받은 굴착공사정보지원센터(이하 "정보지원센터"라 한다)에 확인을 요청할 때에는 다음 각 호의 사항이 포함된 굴착계획을 정보지원센터에 통보해야 한다.

② 제1항에 따라 굴착계획을 통보하려는 자가 「도로법」 제61조에 따른 도로점용 허가를 받은 경우로서 그 허가관청이 제1항에 따른 굴착계획에 관한 정보를 굴착공사를 시작하기 24시간 전까지 정보지원센터에 제공한 경우에는 굴착공사자가 굴착계획을 통보한 것으로 본다. <개정 2023.10.10>

③ 정보지원센터는 제1항에 따라 굴착계획을 통보받으면 굴착공사자에게 접수번호를 내주어야 한다. 다만, 제2항에 따라 허가관청이 굴착계획에 관한 정보를 정보지원센터에 제공한 경우에는 정보통신망에 접수번호를 부여하여 굴착공사자가 정보통신망을 통하여 이를 확인하게 할 수 있다.

④ 정보지원센터는 제1항에 따라 굴착공사자로부터 굴착계획을 통보받으면 즉시 정보통신망을 통해 그 통보내용을 해당 액화석유가스 충전사업자(제72조의3에 해당하는 액화석유가스 충전사업자만을 말한다. 이하 이 조, 제72조의5, 제72조의8부터 제72조의13까지 및 별표 20의2에서 같다)나 액화석유가스 집단공급사업자(액화석유가스 배관망공급사업자와 액화석유가스 일반집단공급사업자 중 도로 또는 타인의 토지에 매설된 배관을 통하여 액화석유가스를 공급하는 액화석유가스 일반집단공급사업자만을 말한다. 이하 이 조, 제72조의5, 제72조의8부터 제72조의13까지 및 별표 20의2에서 같다)에게 알려 주어야 한다.

⑤ 액화석유가스 충전사업자 및 액화석유가스 집단공급사업자는 제4항에 따라 정보지원센터로부터 굴착계획의 통보내용을 통지받은 때부터 24시간 이내에 매설된 배관이 있는지를 확인하고 그 결과를 정보지원센터에 통지해야 한다. 이 경우 토요일 및 「관공서의 공휴일에 관한 규정」 제2조에 따른 공휴일은 통지시간에 포함하지 않는다.

⑥ 제1항에 따라 통보된 굴착계획의 유효기간은 15일로 하고, 굴착계획을 정보지원센터에 통보한 날 또는 굴착공사 예정일부터 15일이 지난 날까지 제72조의5에 따라 굴착공사 현장 위치 및 액화석유가스배관 매설 위치를 표시하지 않은 경우 굴착공사자는 굴착계획을 다시 통보해야 한다.
