약사법 제46조의2(의약품 판촉영업자 신고)

① 의약품의 품목허가를 받은 자, 수입자 또는 의약품 도매상(이하 "의약품공급자"라 한다)으로부터 의약품의 판매촉진 업무를 위탁받아 수행하려는 자(위탁된 판매촉진 업무를 다시 위탁받아 수행하려는 자도 포함한다)는 보건복지부령으로 정하는 기준에 따라 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장(자치구의 구청장을 말한다. 이하 같다)에게 신고하여야 한다. 신고한 사항 중 보건복지부령으로 정하는 중요한 사항을 변경하려는 경우에도 또한 같다.

② 제1항에 따라 신고한 자(이하 "의약품 판촉영업자"라 한다)가 다음 각 호의 어느 하나에 해당하는 경우에는 보건복지부령으로 정하는 바에 따라 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 신고하여야 한다. 다만, 휴업기간이 1개월 미만인 경우에는 그러하지 아니하다.

③ 다음 각 호의 어느 하나에 해당하는 자의 의약품 판촉영업자 신고는 수리하지 아니한다. <개정 2024.12.20>

④ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따른 신고를 받거나 제2항에 따른 폐업, 휴업 또는 영업 재개의 신고를 받은 날부터 3일 이내에 신고수리 여부를 신고인에게 통지하여야 한다.

(4) The^ð더 Special스페실 Self-Governing셀^f프-거^v버닝 City시티 Mayor,메이어 Special스페실 Self-Governing셀^f프-거^v버닝 Province프^r라^v븐스 Governor,거^v버너 or오 head헤드 of어^v브 a어 Si/Gun/Gu시 shall섈 notify노우터^f파이 the^ð더 reporting^r리포팅 person퍼슨 whether웨^ð더 the^ð더 report^r리포트 has해즈 been빈 accepted액셉티드 within위^ð딘 three^θ쓰^r리 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 receiving^r러시^v빙 a어 report^r리포트 under언더 paragraph패^r러그^r래^f프 (1) or오 a어 report^r리포트 of어^v브 closure,클로우저 suspension,서스펜션 or오 resumption^r리점프션 of어^v브 business비즈니스 under언더 paragraph패^r러그^r래^f프 (2).

⑤ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장이 제4항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다.

(5) If이^f프 the^ð더 Special스페실 Self-Governing셀^f프-거^v버닝 City시티 Mayor,메이어 Special스페실 Self-Governing셀^f프-거^v버닝 Province프^r라^v븐스 Governor,거^v버너 or오 head헤드 of어^v브 a어 Si/Gun/Gu시 fails^f페일즈 to투 notify노우터^f파이 the^ð더 reporting^r리포팅 person,퍼슨 within위^ð딘 the^ð더 period피^r리어드 specified스페서^f파이드 in인 paragraph패^r러그^r래^f프 (4), of어^v브 whether웨^ð더 the^ð더 report^r리포트 has해즈 been빈 accepted액셉티드 or오 of어^v브 an앤 extension익스텐션 of어^v브 the^ð더 processing프^r라세싱 period피^r리어드 under언더 the^ð더 statutes스태춧츠 on안 handling핸들링 civil시^v블 petitions,퍼티션즈 the^ð더 report^r리포트 shall섈 be비 deemed딤드 accepted액셉티드 on안 the^ð더 day데이 after애^f프터 that^ð댓 period피^r리어드 (or,오 where웨어 the^ð더 processing프^r라세싱 period피^r리어드 has해즈 been빈 extended익스텐디드 or오 further^f퍼^ð더 extended익스텐디드 under언더 the^ð더 statutes스태춧츠 on안 handling핸들링 civil시^v블 petitions,퍼티션즈 that^ð댓 processing프^r라세싱 period)피^r리어드 ends.엔즈
