어장관리법 제2조(정의)

1. "어장"이란 「수산업법」 제7조에 따른 면허(이하 "어업면허"라 한다)나 같은 법 제40조제3항에 따른 허가(이하 "어업허가"라 한다)를 받아 어업을 하는 일정한 수면(水面)과「양식산업발전법」 제10조제1호부터 제6호에 따른 면허(이하 "양식업면허"라 한다)를 받아 양식하는 수면을 말한다.

2. "어업"이란 어업면허 또는 어업허가를 받아 수산동식물을 포획ㆍ채취하는 사업을 말한다.

2의2. "양식업"이란 「양식산업발전법」 제2조제2호에 따라 수산동식물을 양식하는 사업을 말한다.

3. "면허ㆍ허가동시갱신"이란 행정청이 관할하고 있는 어장관리 해역별로 어장을 정화하거나 정비하기 위하여 그 어장에 관한 종전의 어업면허, 어업허가 또는 양식업면허를 취소하고 동시에 그 취소된 자에게 새로운 어업면허, 어업허가 또는 양식업면허를 하는 것을 말한다.

4. "어장휴식"이란 환경이 심하게 오염되어 병해(病害)가 자주 생기고 생산성이 떨어진 어장에 대하여 그 어업 또는 양식업을 일정 기간 쉬게 하는 것을 말한다.

5. "어장정화ㆍ정비"란 환경오염으로 인하여 생기는 어장의 피해를 막고 어장을 효율적으로 이용하며 지속가능한 어업과 양식업생산의 기반을 조성하기 위하여 하여야 하는 다음 각 목의 어느 하나에 해당하는 일 또는 그와 유사한 것을 말한다.

6. "어장정화ㆍ정비업"이란 어장을 정화하거나 정비하는 사업을 말한다.

7. "어장환경"이란 어장에 서식하는 생물체와 이를 둘러싸고 있는 바닷물, 해저지형 등 비생물적 환경 및 어장에서의 인간의 행동양식을 포함하는 것으로서 어장의 자연 및 생태를 말한다.
