영유아보육법 제32조(치료 및 예방조치)

① 어린이집의 원장은 제31조에 따른 건강진단 결과 질병에 감염되었거나 감염될 우려가 있는 영유아에 대하여 그 보호자와 협의하여 질병의 치료와 예방에 필요한 조치를 하여야 한다. <개정 2011.6.7>

② 어린이집의 원장은 다음 각 호의 어느 하나에 해당하는 영유아, 어린이집 거주자 및 보육교직원을 교육부령으로 정하는 바에 따라 어린이집으로부터 격리시키는 등 필요한 조치를 할 수 있다. <신설 2011.8.4, 2020.12.29, 2023.12.26>

③ 어린이집의 원장은 제1항의 조치를 위하여 필요하면 「지역보건법」 제10조와 제13조에 따른 보건소 및 보건지소, 「의료법」 제3조에 따른 의료기관에 협조를 구할 수 있다. <개정 2011.6.7, 2011.8.4, 2015.5.18>

④ 제2항에 따라 협조를 요청받은 보건소ㆍ보건지소 및 의료기관의 장은 적절한 조치를 취하여야 한다. <개정 2011.8.4>

⑤ 어린이집의 원장은 간호사(간호조무사를 포함한다)로 하여금 영유아가 의사의 처방, 지시에 따라 투약행위를 할 때 이를 보조하게 할 수 있다. 이 경우 어린이집의 원장은 보호자의 동의를 받아야 한다. <신설 2016.2.3>
