원양산업발전법 제6조의3(원양어업허가를 받은 자의 지위 승계)

① 제6조에 따라 원양어업허가를 받은 어선을 그 허가를 받은 자로부터 상속받거나 매입(「민사집행법」에 따른 경매나 그 밖에 이에 준하는 절차에 따라 매입하는 경우를 포함한다) 또는 임차한 자(원양어업허가를 받은 자가 법인인 경우에는 합병ㆍ분할 후 존속하는 법인을 포함한다)는 그 허가를 받은 자의 지위를 승계한다(상속의 경우 상속인이 반대의 의사표시를 한 경우는 제외한다). 이 경우 종전에 원양어업허가를 받은 자의 지위는 그 효력을 잃는다.

② 제1항에 따라 원양어업허가를 받은 자의 지위를 승계한 자는 승계받은 날부터 30일(상속의 경우에는 60일로 한다) 이내에 해양수산부장관에게 그 승계 사실을 해양수산부령으로 정하는 절차에 따라 신고하여야 하며, 해양수산부령으로 정하는 원양어업허가를 받은 어선의 기준을 갖추지 아니한 자는 승계받은 날부터 90일 이내에 그 기준을 갖추어야 한다.

(2) A어 person퍼슨 who후 has해즈 succeeded석시디드 to투 the^ð더 status스태터스 of어^v브 a어 person퍼슨 who후 obtained어브테인드 distant디스턴트 water워터 fisheries^f피셔^r리즈 permission퍼미션 under언더 paragraph패^r러그^r래^f프 (1) shall섈 report^r리포트 the^ð더 fact^f팩트 of어^v브 succession석세션 to투 the^ð더 Minister미너스터 of어^v브 Oceans오우션즈 and앤드 Fisheries^f피셔^r리즈 within위^ð딘 30 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 succession석세션 (60 days데이즈 in인 the^ð더 case케이스 of어^v브 inheritance),인헤^r러튼스 in인 accordance어코든스 with위^ð드 the^ð더 procedures프^r러시저즈 prescribed프^r리스크^r라이브드 by바이 Ordinance오더넌스 of어^v브 the^ð더 Ministry미너스트^r리 of어^v브 Oceans오우션즈 and앤드 Fisheries,^f피셔^r리즈 and앤드 a어 person퍼슨 who후 does더즈 not낫 meet밋 the^ð더 standards스탠더즈 for^f포 fishing^f피슁 vessels^v베슬즈 with위^ð드 distant디스턴트 water워터 fisheries^f피셔^r리즈 permission퍼미션 prescribed프^r리스크^r라이브드 by바이 Ordinance오더넌스 of어^v브 the^ð더 Ministry미너스트^r리 of어^v브 Oceans오우션즈 and앤드 Fisheries^f피셔^r리즈 shall섈 meet밋 the^ð더 standards스탠더즈 within위^ð딘 90 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 succession.석세션

③ 해양수산부장관은 제2항에 따른 신고를 받은 경우 그 내용을 검토하여 이 법에 적합하면 신고를 수리하여야 한다.

(3) Upon어판 receiving^r러시^v빙 a어 report^r리포트 under언더 paragraph패^r러그^r래^f프 (2), the^ð더 Minister미너스터 of어^v브 Oceans오우션즈 and앤드 Fisheries^f피셔^r리즈 shall섈 review^r리^v뷰 its잇츠 contents칸텐츠 and앤드 accept액셉트 the^ð더 report^r리포트 if이^f프 it잇 conforms컨^f폼즈 to투 this^ð디스 Act.액트

④ 제1항에 따라 원양어업허가를 받은 자의 지위를 승계한 자는 그 원양어업허가에 부과된 행정처분 또는 부담이나 조건 등도 함께 승계한 것으로 본다. 다만, 원양어업허가를 받은 자의 지위를 승계한 자가 그 처분이나 위반사실을 알지 못하였음을 증명하는 때에는 그러하지 아니하다.

(4) A어 person퍼슨 who후 has해즈 succeeded석시디드 to투 the^ð더 status스태터스 of어^v브 a어 person퍼슨 who후 obtained어브테인드 distant디스턴트 water워터 fisheries^f피셔^r리즈 permission퍼미션 under언더 paragraph패^r러그^r래^f프 (1) shall섈 be비 deemed딤드 to투 have해^v브 also올소 succeeded석시디드 to투 administrative어드미너스트^r레이티^v브 dispositions,디스퍼지션즈 burdens,버든즈 or오 conditions컨디션즈 imposed임포우즈드 on안 the^ð더 distant디스턴트 water워터 fisheries^f피셔^r리즈 permission.퍼미션 However,하우에^v버 this^ð디스 shall섈 not낫 apply어플라이 where웨어 the^ð더 person퍼슨 who후 has해즈 succeeded석시디드 proves프^r루^v브즈 that^ð댓 he히 or오 she쉬 did디드 not낫 know노우 of어^v브 the^ð더 disposition디스퍼지션 or오 the^ð더 violation.^v바이얼레이션

⑤ 해양수산부장관은 제2항에 따른 신고를 받았을 때에는 「가족관계의 등록 등에 관한 법률」 제13조에 따라 등록전산정보자료를 공동이용할 수 있다.

⑥ 제1항에 따라 원양어업허가를 받은 자의 지위를 승계받은 자의 결격사유에 관하여는 제8조를 준용한다. 다만, 제8조제1항 후단에 해당하는 법인이 6개월 이내에 그 임원을 교체하여 임명한 경우 또는 상속인이 피상속인이 사망한 날부터 6개월 이내에 그 원양어업허가를 받은 자의 지위를 다른 사람에게 양도한 경우에는 그러하지 아니하다.
