이자제한법 제3조(이자의 사전공제)

선이자를 사전공제한 경우에는 그 공제액이 채무자가 실제 수령한 금액을 원본으로 하여 제2조제1항에서 정한 최고이자율에 따라 계산한 금액을 초과하는 때에는 그 초과부분은 원본에 충당한 것으로 본다.
