Enforcement Decree of the Seal Impression Certification Act, Article 17-2 (Application for and Cancellation of Seal Protection)

①법 제14조의2제1항에 따라 인감보호 신청을 하는 경우에는 본인이 인감증명서발급기관을 방문하여 별지 제15호의3서식 또는 별지 제15호의4서식에 따른 인감보호신청서와 함께 주민등록증등을 제출한 후 인감대장에 필요한 사항의 기재를 요청할 수 있다. 다만, 본인의 인감대장을 관리하고 있는 증명청을 방문하여 신청하는 경우에는 구술로 신청할 수 있다. <개정 2003.9.29, 2005.1.15, 2013.4.22, 2015.1.20, 2016.1.12, 2016.7.5>

②인감을 신고한 재외국민, 해외거주(체류)자 또는 수감자가 대리인으로 하여금 인감보호 신청을 하려는 경우에는 별지 제15호의3서식 또는 별지 제15호의4서식에 따른 인감보호신청서에 거주지를 관할하는 재외공관의 확인 또는 수감기관의 확인을 받아 인감증명서발급기관에 제출하여야 한다. 이 경우 인감보호신청서를 제출받은 인감증명서발급기관은 주민등록증등에 의하여 대리인의 신분을 확인하여야 한다. <신설 2003.9.29, 2005.1.15, 2007.12.31, 2015.1.20, 2016.1.12, 2016.7.5>

④ 제1항 본문에도 불구하고 인감보호 신청을 하려는 자가 피성년후견인인 경우에는 성년후견인이 신청하여야 하고, 미성년자인 경우에는 미성년자가 법정대리인의 동의를 받아 신청하여야 하며, 피한정후견인인 경우에는 피한정후견인이 한정후견인의 동의를 받아 신청하여야 한다. 다만, 피한정후견인이 인감보호 신청을 하는 경우 등기사항증명서에 한정후견인이 인감신고에 관한 대리권을 행사할 수 있다고 기재된 경우에는 한정후견인이 피한정후견인의 인감보호 신청을 할 수 있다. <개정 2016.7.5>

⑤제1항 단서에 따라 인감보호 신청을 받은 증명청은 인감대장의 인감보호신청란에 요청한 사항을 기재하고 신청인으로 하여금 확인하도록 한 후 신청인이 본인인 경우에는 서명 또는 무인을, 대리인인 경우에는 무인을 받아야 한다. <개정 2003.9.29, 2016.1.12, 2016.7.5>

1. 인감보호의 해지를 신청하려는 사람은 그 대리인으로 하여금 별지 제15호의6서식의 인감보호해지 방문확인 신청서에 증명서류를 첨부하여 입원한 시설을 관할하는 읍장ㆍ면장ㆍ동장 또는 출장소장에게 제출하게 하여야 한다.
