Enforcement Rule of the Act on Funeral Services, etc., Article 14 (Methods of Disposing of Graves Whose Period of Installation Has Expired)

① 법 제20조제3항에 따른 공설묘지 또는 사설묘지의 설치자가 설치기간이 지난 분묘의 처리를 하는 경우 그 통보 및 공고기간ㆍ방법ㆍ절차 등은 다음 각 호와 같다. <개정 2015.7.20, 2018.6.20>

1. 묘지의 연고자를 알고 있는 경우：법 제20조제2항에 따른 조치를 하기 3개월 전에 다음 각 목의 사항을 문서로 표시하여 해당 분묘의 연고자에게 알릴 것

다. 공설묘지 또는 사설묘지 설치자의 성명ㆍ주소 및 연락방법

라. 그 밖에 개장에 필요한 사항

2. 묘지의 연고자를 알 수 없는 경우: 법 제20조제2항에 따른 조치를 하기 3개월 전에 다음 각 목의 어느 하나의 방법으로 제1호 각 목의 사항을 2회 이상 공고하되, 두 번째 공고는 첫 번째 공고일부터 40일이 지난 후에 다시 할 것

② 사설묘지의 설치자가 법 제20조제2항에 따라 설치기간이 끝난 분묘를 처리하기 위하여 제2조제3항에 따른 개장신고를 하려는 경우에는 제1항에 따른 통보문 또는 공고문을 첨부하여야 한다.
