재난 및 안전관리 기본법 제75조의3(공인재난관리사 자격증 교부 등)

① 행정안전부장관은 재난의 예방ㆍ대비ㆍ대응ㆍ복구 등의 업무수행 역량을 검정하는 자격시험(이하 "공인재난관리사 자격시험"이라 한다)에 합격하고 행정안전부령으로 정하는 연수과정을 수료한 사람에게 공인재난관리사의 자격증을 교부할 수 있다.

② 다음 각 호의 어느 하나에 해당하는 사람은 공인재난관리사가 될 수 없다.

③ 공인재난관리사 자격시험은 제1차 시험과 제2차 시험으로 구분하여 실시하되 「국가기술자격법」 또는 다른 법률에 따른 재난 및 안전관리와 관련된 자격을 보유한 사람 등 대통령령으로 정하는 사람에 대하여는 제1차 시험을 면제할 수 있다.

(3) The^ð더 certified서터^f파이드 disaster디재스터 manager매너저 examination이그재머네이션 shall섈 be비 divided디^v바이디드 into인투 a어 first^f퍼스트 and앤드 a어 second세큰드 examination;이그재머네이션 provided,프^r러^v바이디드 however,하우에^v버 that^ð댓 the^ð더 first^f퍼스트 examination이그재머네이션 may메이 be비 waived웨이^v브드 for^f포 persons퍼슨즈 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree,디크^r리 such서치 as애즈 persons퍼슨즈 holding호울딩 qualifications콸러^f퍼케이션즈 related^r릴레이티드 to투 disaster디재스터 and앤드 safety세이^f프티 management매너지먼트 under언더 the^ð더 National내셔늘 Technical텍니클 Qualifications콸러^f퍼케이션즈 Act액트 or오 other어^ð더 Acts.액츠

④ 공인재난관리사 자격의 취득과 관련된 다음 각 호의 사항을 심의하기 위하여 행정안전부에 공인재난관리사자격심의위원회를 둘 수 있다.

(4) A어 Certified서터^f파이드 Disaster디재스터 Manager매너저 Qualification콸러^f퍼케이션 Deliberation딜리버^r레이션 Committee커미티 may메이 be비 established이스태블리시트 within위^ð딘 the^ð더 Ministry미너스트^r리 of어^v브 the^ð디 Interior인티^r리어 and앤드 Safety세이^f프티 to투 deliberate딜리버^r럿 on안 the^ð더 following^f팔로잉 matters매터즈 concerning컨서닝 the^ð디 acquisition애쿼지션 of어^v브 certified서터^f파이드 disaster디재스터 manager매너저 qualifications:콸러^f퍼케이션즈

⑤ 부정한 방법으로 공인재난관리사 자격시험에 응시한 사람 또는 공인재난관리사 자격시험에서 부정행위를 한 사람에 대해서는 그 시험을 정지시키거나 합격을 무효로 한다. 이 경우 공인재난관리사 자격시험이 정지되거나 합격이 무효처리된 사람은 그 처분일부터 3년간 공인재난관리사 자격시험에 응시할 수 없다.

⑥ 행정안전부장관은 공인재난관리사가 다음 각 호의 어느 하나에 해당하는 경우 그 자격을 취소하여야 한다.

(6) The^ð더 Minister미너스터 of어^v브 the^ð디 Interior인티^r리어 and앤드 Safety세이^f프티 shall섈 revoke^r리^v보우크 the^ð더 qualification콸러^f퍼케이션 of어^v브 a어 certified서터^f파이드 disaster디재스터 manager매너저 in인 any에니 of어^v브 the^ð더 following^f팔로잉 cases:케이시즈

⑦ 누구든지 제1항에 따라 교부받은 자격증을 다른 사람에게 빌려주거나 빌려서는 아니 되며, 이를 알선하여서도 아니 된다.

(7) No노우 one원 shall섈 lend렌드 a어 certificate서티^f피컷 issued이슈드 under언더 paragraph패^r러그^r래^f프 (1) to투 another어너^ð더 person,퍼슨 borrow바^r로우 one,원 or오 arrange어^r레인지 for^f포 such서치 lending렌딩 or오 borrowing.바^r로잉

⑧ 행정안전부장관은 제6항에 따라 자격을 취소하려면 청문을 하여야 한다.

(8) The^ð더 Minister미너스터 of어^v브 the^ð디 Interior인티^r리어 and앤드 Safety세이^f프티 shall섈 hold호울드 a어 hearing히^r링 before비^f포 revoking^r리^v보우킹 a어 qualification콸러^f퍼케이션 under언더 paragraph패^r러그^r래^f프 (6).

⑨ 공인재난관리사 자격시험의 시험과목, 시험방법, 응시자격, 공인재난관리사자격심의위원회의 구성 및 운영, 그 밖에 시험에 관하여 필요한 사항은 대통령령으로 정한다.
