전기통신사업법 제80조(설비의 이전 등)

① 기간통신사업자의 전기통신설비가 설치되어 있는 토지등이나 이에 인접한 토지등의 이용목적이나 이용방법이 변경되어 그 설비가 토지등의 이용에 방해가 되는 경우에는 그 토지등의 소유자나 점유자는 기간통신사업자에게 전기통신설비의 이전이나 그 밖에 방해 제거에 필요한 조치를 요구할 수 있다.

② 기간통신사업자는 제1항에 따른 요구를 받은 경우 해당 조치를 하는 것이 업무의 수행상 또는 기술상 곤란한 경우가 아니면 필요한 조치를 하여야 한다.

③ 제2항의 조치에 필요한 비용은 해당 설비의 설치 이후에 그 설비의 이전이나 그 밖에 방해 제거에 필요한 조치의 원인을 제공한 자가 부담한다. 다만, 기간통신사업자는 그 비용을 부담하는 자가 해당 토지등의 소유자나 점유자인 경우로서 다음 각 호의 어느 하나에 해당하는 경우에는 해당 설비를 설치할 때 보상금액, 설비기간 등을 고려하여 그 토지등의 소유자나 점유자가 부담하는 비용을 감면할 수 있다.
