전사ㆍ순직한 진급예정자의 진급에 관한 특별법 제3조(전사ㆍ순직한 진급예정자의 진급)

① 「군인사법」 제30조제1항에 따라 전사자 또는 순직자를 진급시키는 경우, 전사ㆍ순직진급예정자에 대하여는 그 사망일 전날을 진급 발령일로 하여 진급 예정 계급으로 진급한 것으로 본다.

② 전사ㆍ순직진급예정자에 대하여는 제1항에 따라 진급한 것으로 보는 계급으로부터 「군인사법」 제30조제1항에 따라 다시 진급시킬 수 있다. 이 경우 장성급 장교로 진급하게 되는 전사ㆍ순직진급예정자에 대하여는 「군인사법」 제29조에 따른 장교진급 선발위원회의 심사를 거쳐야 한다.
