정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률 제2조(기본이념)

① 모든 국민은 정신질환으로부터 보호받을 권리를 가진다.

③ 모든 정신질환자는 정신질환이 있다는 이유로 부당한 차별대우를 받지 아니한다.

④ 미성년자인 정신질환자는 특별히 치료, 보호 및 교육을 받을 권리를 가진다.

⑤ 정신질환자에 대해서는 입원 또는 입소(이하 "입원등"이라 한다)가 최소화되도록 지역 사회 중심의 치료가 우선적으로 고려되어야 하며, 정신건강증진시설에 자신의 의지에 따른 입원 또는 입소(이하 "자의입원등"이라 한다)가 권장되어야 한다.

⑥ 정신건강증진시설에 입원등을 하고 있는 모든 사람은 가능한 한 자유로운 환경을 누릴 권리와 다른 사람들과 자유로이 의견교환을 할 수 있는 권리를 가진다.

⑦ 정신질환자는 원칙적으로 자신의 신체와 재산에 관한 사항에 대하여 스스로 판단하고 결정할 권리를 가진다. 특히 주거지, 의료행위에 대한 동의나 거부, 타인과의 교류, 복지서비스의 이용 여부와 복지서비스 종류의 선택 등을 스스로 결정할 수 있도록 자기결정권을 존중받는다.

⑧ 정신질환자는 자신에게 법률적ㆍ사실적 영향을 미치는 사안에 대하여 스스로 이해하여 자신의 자유로운 의사를 표현할 수 있도록 필요한 도움을 받을 권리를 가진다.
