정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률 제48조(입원적합성의 조사)

① 입원적합성심사위원회의 위원장은 제47조제1항에 따라 입원심사소위원회에 회부하기 전에 입원등을 한 사람이 대면조사를 신청하거나 입원등의 적합성이 의심되는 등 대통령령으로 정하는 사유가 있는 경우에는 직권으로 그 국립정신병원등의 소속 직원(이하 "조사원"이라 한다)에게 해당 정신의료기관등을 출입하여 입원등을 한 사람을 직접 면담하고 입원등의 적합성, 퇴원등의 필요성 여부를 조사하게 할 수 있다.

② 제1항에 따라 조사를 수행하는 조사원은 해당 정신의료기관등의 장에게 다음 각 호의 사항을 요구할 수 있다. 이 경우 정신의료기관등의 장은 대통령령으로 정하는 특별한 사정이 없으면 이에 협조하여야 한다.

③ 제1항 및 제2항에 따라 조사를 수행하는 조사원은 권한을 나타내는 증표를 지니고 이를 조사대상자에게 보여주어야 한다.

④ 제1항 및 제2항에 따른 조사원의 자격, 정신의료기관등에의 출입, 면담 등 조사 방법 및 절차 등에 필요한 사항은 대통령령으로 정한다.
