① 정신의료기관등의 장은 입원등을 한 사람에 대하여 치료 또는 보호의 목적으로 정신건강의학과전문의의 지시에 따라 하는 경우가 아니면 격리시키거나 묶는 등의 신체적 제한을 할 수 없다.

② 정신의료기관등의 장은 치료 또는 보호의 목적으로 정신건강의학과전문의의 지시에 따라 입원등을 한 사람을 격리시키거나 묶는 등의 신체적 제한을 하는 경우에도 자신이나 다른 사람을 위험에 이르게 할 가능성이 뚜렷하게 높고 신체적 제한 외의 방법으로 그 위험을 회피하는 것이 뚜렷하게 곤란하다고 판단되는 경우에만 제1항에 따른 신체적 제한을 할 수 있다. 이 경우 격리는 해당 시설 안에서 하여야 한다.
