주식ㆍ사채 등의 전자등록에 관한 법률 제52조(법무부장관의 검사 요청 등)

① 법무부장관은 이 법의 목적을 달성하기 위하여 필요한 경우 전자등록기관에 보고 또는 자료의 제출을 요구하거나 금융위원회에 전자등록기관에 대한 검사를 요청할 수 있으며 그 검사에 법무부 소속 공무원이 참여하도록 할 수 있다.

② 금융위원회는 제1항에 따른 법무부장관의 검사 요청을 받은 경우 그 검사를 금융감독원장에게 위탁하여 하게 할 수 있다.

③ 금융감독원장은 제2항에 따른 금융위원회의 위탁을 받아 검사를 한 경우에는 그 보고서를 법무부장관에게 제출하여야 한다. 이 경우 검사보고서의 내용은 제14조제1항 각 호의 업무, 같은 조 제2항 각 호의 업무 및 그 업무와 관련된 재산의 검사에 관한 사항으로 한정하며, 전자등록기관이 이 법 또는 이 법에 따른 명령이나 처분을 위반한 사실이 있으면 그 처리에 관한 의견서를 첨부하여야 한다.

④ 법무부장관은 이 법의 목적을 달성하기 위하여 필요한 경우 금융위원회에 제51조제5항 전단에 따른 검사보고서(같은 항 후단에 따른 의견서를 포함한다)를 송부하여 줄 것을 요청할 수 있다.
