사업조합을 설립하려면 조합원이 될 자격을 가진 자 5명 이상의 발기인이 있어야 한다. 다만, 시ㆍ도 또는 전국을 업무 구역으로 설립하려는 발기인에 대하여는 제27조제1항제1호 및 제2호를 준용한다. <개정 2010.6.8>
