지뢰피해자 지원에 관한 특별법 시행령 제11조(취업가능기간과 장해등급 및 노동력상실률 등)

① 법 제4조제5항에 따른 취업가능기간은 피해자의 나이, 직업, 경력, 건강상태 등 주관적 요소와 국민의 평균여명(平均餘命), 경제수준, 고용조건 등 사회적ㆍ경제적 여건 등을 고려하되, 피해자가 남자인 경우에는 사고 당시 「병역법」에 따른 군복무기간, 피해자의 군복무 가능성, 복무기간 조정 가능성 등을 종합적으로 참작한 기간으로 한다. 다만, 피해자가 56세 이후에 사고를 당한 경우 취업가능기간은 48개월로 한다. <개정 2016.12.30>

② 법 제4조제5항에 따른 장해등급 및 노동력상실률은 별표 1과 같다. 이 경우 장해 부위가 2개일 때의 장해등급은 별표 1에 따라 장해 부위별 등급을 정한 후 별표 2에 따라 종합평가등급을 정한다.

③ 장해 부위가 3개 이상인 경우에는 먼저 최상급 장해 부위 2개에 대하여 별표 2에 따른 종합평가등급을 정한 후 나머지 장해 부위 중 최상급 장해 부위 1개와 종합평가등급을 별표 2에 따라 다시 종합평가하여 등급을 정한다.

④ 장해의 가장 중한 부위가 별표 1에 따른 장해등급 제14급에 해당하는 것이 3개 이상인 경우에는 별표 1에 따른 장해등급 제13급으로 한다.

⑤ 위원회로부터 장해등급 판정을 위하여 국립종합병원ㆍ의과대학부속병원(분원은 제외한다)이나 위원회가 지정하는 병원(이하 "지정병원등"이라 한다)에서 검진받을 것을 통보받은 사람이 그 날부터 1년 이내에 검진을 받지 아니하는 경우에 위원회는 그 사람의 등급을 등외(等外)로 결정할 수 있다. 이 경우 위원회는 그 결정 3개월 전에 등외로 결정될 수 있다는 사실을 통보하고, 최종적으로 검진의 기회를 주어야 한다.

⑥ 법 제4조제5항에 따른 단할인법에 따른 중간이자의 공제방법은 호프만방식을 따른다.
