지방 연구직 및 지도직공무원의 임용 등에 관한 규정 제5조(임용후보자의 전직)
Regulations on Appointment, etc. of Local Research and Guidance Public Officials, Article 5 (Transfer of Appointment Candidates to a Different Series)
① 임용령 제15조에 따라 별표 1의 각 직렬에 임용 또는 추천될 수 있는 임용후보자는 지방자치단체의 장[특별시ㆍ광역시ㆍ특별자치시ㆍ도 또는 특별자치도(이하 "시ㆍ도"라 한다)의 교육감을 포함한다. 이하 같다]과 지방의회의 의장(시ㆍ도의회의 의장과 시ㆍ군ㆍ자치구의회의 의장을 말한다. 이하 같다)이 임용 또는 추천하려는 직렬로의 전직 예정 직급별로 지방자치단체의 규칙(교육규칙 및 의회규칙을 포함한다. 이하 "규칙"이라 한다)에서 정하는 자격기준을 갖추어야 한다. <개정 2021.11.30>
(1) An appointment candidate who may be appointed or recommended to each occupational series in Appendix Table 1 pursuant to Article 15 of the Appointment Decree shall meet the qualification standards, set by Ordinance of the local government (including education regulations and council regulations; hereinafter referred to as "Ordinance"), for each rank to which the candidate is to transfer in the occupational series to which the head of the local government (including the superintendent of education of a Special Metropolitan City, Metropolitan City, Special Self-Governing City, Do, or Special Self-Governing Province (hereinafter referred to as "Si/Do"); the same applies hereinafter) and the chairperson of the local council (meaning the chairperson of a Si/Do council and the chairperson of a Si/Gun/Gu council; the same applies hereinafter) intend to appoint or recommend the candidate.
② 임용후보자가 별표 1의 각 직렬로 전직하는 경우에 관하여 임용령 제15조를 적용할 때에는 같은 조 제2항 중 "제29조제4호 또는 제5호"는 "「지방 연구직 및 지도직공무원의 임용 등에 관한 규정」 제10조제3호"로 본다.
(2) When applying Article 15 of the Appointment Decree to the case where an appointment candidate transfers to each occupational series in Appendix Table 1, "Article 29 subparagraph 4 or 5" in paragraph (2) of that Article is deemed "Article 10 subparagraph 3 of the Regulations on Appointment, etc. of Local Research and Guidance Public Officials".
