지진ㆍ화산재해대책법 시행령 제11조의4(인증의 대상ㆍ기준 및 절차 등)

① 법 제16조의3제1항에 따른 지진안전 시설물의 인증(이하 "인증"이라 한다)을 할 수 있는 시설물은 다음 각 호와 같다. <개정 2020.7.28, 2021.6.1, 2022.10.4>

② 인증 기준 및 등급은 제1항 각 호에 따른 인증 대상 시설물에 대한 내진설계와 그 설계에 따른 시공의 적정성을 고려하여 행정안전부장관이 정하여 고시한다. <개정 2021.6.1>

③ 법 제16조의3제2항에 따라 인증을 신청하려는 자는 행정안전부령으로 정하는 인증신청서(전자문서로 된 신청서를 포함한다)에 다음 각 호의 서류(전자문서를 포함한다)를 첨부하여 행정안전부장관에게 제출해야 한다. <개정 2021.6.1>

(3) A어 person퍼슨 who후 intends인텐즈 to투 apply어플라이 for^f포 certification서터^f퍼케이션 pursuant퍼수언트 to투 Article아터클 16-3 (2) of어^v브 the^ð디 Act액트 shall섈 submit서브밋 an앤 application애플러케이션 for^f포 certification서터^f퍼케이션 prescribed프^r리스크^r라이브드 by바이 Ordinance오더넌스 of어^v브 the^ð더 Ministry미너스트^r리 of어^v브 the^ð디 Interior인티^r리어 and앤드 Safety세이^f프티 (including인클루딩 an앤 application애플러케이션 in인 the^ð더 form^f폼 of어^v브 an앤 electronic일렉트^r라닉 document),다큐멘트 with위^ð드 the^ð더 following^f팔로잉 documents다큐먼츠 (including인클루딩 electronic일렉트^r라닉 documents)다큐먼츠 attached,어태치트 to투 the^ð더 Minister미너스터 of어^v브 the^ð디 Interior인티^r리어 and앤드 Safety:세이^f프티

④ 행정안전부장관은 제3항에 따라 인증신청서를 접수한 날부터 40일 이내에 인증에 대한 심사를 완료하여 당사자에게 그 결과를 통지하여야 한다.

(4) The^ð더 Minister미너스터 of어^v브 the^ð디 Interior인티^r리어 and앤드 Safety세이^f프티 shall섈 complete컴플릿 the^ð더 review^r리^v뷰 for^f포 certification서터^f퍼케이션 within위^ð딘 40 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 receiving^r러시^v빙 the^ð디 application애플러케이션 for^f포 certification서터^f퍼케이션 under언더 paragraph패^r러그^r래^f프 (3) and앤드 notify노우터^f파이 the^ð더 party파티 of어^v브 the^ð더 result.^r리절트

⑤ 행정안전부장관은 제4항에 따라 인증을 하는 경우에는 인증을 신청한 자에게 행정안전부령으로 정하는 지진안전 시설물 인증서와 행정안전부장관이 정하여 고시하는 바에 따라 제작된 인증명판(認證名板)을 발급해야 한다. <개정 2021.6.1>

⑥ 행정안전부장관은 제3항에 따라 인증을 신청한 자에게 인증에 필요한 비용을 부담하게 할 수 있다. <개정 2021.6.1>

⑦ 제1항부터 제6항까지에서 규정한 사항 외에 인증에 필요한 사항은 행정안전부장관이 정하여 고시한다.
