진술조력인의 선정 등에 관한 규칙 제12조(진술조력인명부의 작성)

① 법 제35조제3항에 따른 진술조력인 명부(이하 "진술조력인명부"라 한다)는 별지 제3호서식에 따른다. 진술조력인명부에는 해당 진술조력인이 원활하게 조력할 수 있는 피해자의 연령, 장애 특성, 범죄 종류 등을 전문분야로 기재할 수 있다.

② 법무부장관은 진술조력인 자격 등이 변경된 경우에는 그 내용을 진술조력인명부에 기재하여야 한다.

③ 법무부장관은 작성한 진술조력인명부를 법원행정처장, 검찰총장, 중대범죄수사청장, 경찰청장 및 해양경찰청장에게 송부하여야 한다. <개정 2023.7.4, 2026.10.1>

④ 법무부장관은 직무범위 및 수사관할 등을 고려해 진술조력인명부를 국방부장관, 고위공직자범죄수사처장 또는 「사법경찰관리의 직무를 수행할 자와 그 직무범위에 관한 법률」에 따라 사법경찰관리의 직무를 수행하는 자가 소속된 기관의 장에게 송부할 수 있다. <신설 2023.7.4>
