진술조력인의 선정 등에 관한 규칙 제19조(진술조서 등의 기재 사항 등)

① 검사 또는 사법경찰관은 법 제36조제1항에 따라 사실관계 확인이나 면담 또는 조사과정에 진술조력인을 참여하게 하여 면담결과서 또는 진술조서를 작성하는 경우에는 그 면담결과서 또는 진술조서에 진술조력인을 통하여 피해자등과의 의사소통을 중개 또는 보조하도록 하였다는 취지를 적고, 진술조력인의 기명날인 또는 서명을 받아야 한다. <개정 2023.7.4, 2026.10.1>

② 검사 또는 사법경찰관은 법 제36조제1항에 따라 사실관계 확인이나 면담 또는 조사과정에 진술조력인을 참여하게 하여 영상녹화를 실시한 경우에는 제작된 영상녹화물(CD, DVD 등을 말한다)에 해당 검사 또는 사법경찰관, 피해자 등의 기명날인 또는 서명과 함께 진술조력인의 기명날인 또는 서명을 받아야 한다. <개정 2026.10.1>
