채무자 회생 및 파산에 관한 법률 제102조(어음채무지급의 예외)

①제100조제1항의 규정은 채무자로부터 어음의 지급을 받은 자가 그 지급을 받지 아니하면 채무자의 1인 또는 여럿에 대한 어음상의 권리를 상실하게 된 경우에는 적용하지 아니한다.

②제1항의 경우 최종의 상환의무자 또는 어음의 발행을 위탁한 자가 그 발행 당시 지급의 정지등이 있는 것을 알았거나 과실로 인하여 알지 못한 때에는 관리인은 그로 하여금 채무자가 지급한 금액을 상환하게 할 수 있다.
