책임운영기관의 설치ㆍ운영에 관한 법률 시행령 제29조의2(기탁물품의 접수기관 및 접수절차 등)

① 법 제39조의2제1항에 따라 자발적으로 기탁되는 물품(이하 "기탁물품"이라 한다)을 접수할 수 있는 책임운영기관(이하 "접수기관"이라 한다)의 장은 별표 1의 책임운영기관 중 위원회의 심의를 거쳐 행정안전부장관이 정하여 고시하는 책임운영기관의 장으로 한다. <개정 2014.6.3, 2014.11.19, 2017.7.26, 2024.7.9>

(1) The^ð더 head헤드 of어^v브 an앤 executive이그제큐티^v브 agency에이전시 that^ð댓 may메이 receive^r러시^v브 voluntarily^v발런테^r럴리 donated도우네이티드 goods구즈 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 "donated도우네이티드 goods")구즈 pursuant퍼수언트 to투 Article아터클 39-2 (1) of어^v브 the^ð디 Act액트 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 a어 "receiving^r러시^v빙 agency")에이전시 shall섈 be비 the^ð더 head헤드 of어^v브 an앤 executive이그제큐티^v브 agency에이전시 designated데지그네이티드 and앤드 publicly퍼블리클리 notified노우터^f파이드 by바이 the^ð더 Minister미너스터 of어^v브 the^ð디 Interior인티^r리어 and앤드 Safety세이^f프티 after애^f프터 deliberation딜리버^r레이션 by바이 the^ð더 Committee커미티 from^f프^r럼 among어멍 the^ð디 executive이그제큐티^v브 agencies에이전시즈 in인 Attached어태치트 Table테이블 1.

② 기탁물품이란 협찬품, 기념품 등 명칭이 어떠하든 기탁자가 반대급부 없이 자발적으로 소유권을 이전하는 물품을 말한다. 다만, 「국유재산법」 제5조제1항제1호부터 제3호까지의 규정에 해당하는 물품은 제외한다.

③ 기탁자가 기탁물품을 기탁하려는 경우에는 기탁물품의 사용 용도와 목적을 구체적으로 적은 별지 서식의 지정기탁서를 접수기관의 장에게 제출하여야 한다.

④ 제3항에 따라 지정기탁서를 제출받은 접수기관의 장은 소속중앙행정기관의 장을 거쳐 다음 각 호의 서류를 행정안전부장관에게 제출한 후 위원회의 심의를 거쳐야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26>

(4) The^ð더 head헤드 of어^v브 the^ð더 receiving^r러시^v빙 agency에이전시 that^ð댓 received^r러시^v브드 the^ð더 designated데지그네이티드 donation도네이션 form^f폼 under언더 paragraph패^r러그^r래^f프 (3) shall섈 submit서브밋 the^ð더 following^f팔로잉 documents다큐먼츠 to투 the^ð더 Minister미너스터 of어^v브 the^ð디 Interior인티^r리어 and앤드 Safety세이^f프티 through^θ쓰^r루 the^ð더 head헤드 of어^v브 the^ð더 supervising수퍼^v바이징 central센트^r럴 administrative어드미너스트^r레이티^v브 agency,에이전시 and앤드 then^ð덴 undergo언더고우 deliberation딜리버^r레이션 by바이 the^ð더 Committee:커미티

⑤ 위원회는 제4항에 따라 심의를 할 때 기탁물품이 다음 각 호의 어느 하나에 해당하는 경우에는 이를 접수가 허용되는 기탁물품으로 보지 아니한다.

⑥ 위원회는 심의를 위하여 필요한 경우에는 관계 공무원이나 전문가를 출석시켜 의견을 듣거나 관계 기관 또는 단체에 자료나 의견의 제출 등을 요청할 수 있다.

⑦ 행정안전부장관은 제4항 및 제5항에 따른 위원회의 심의 결과를 해당 접수기관의 장, 해당 소속중앙행정기관의 장 및 재정경제부장관에게 알려야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2025.12.30>

(7) The^ð더 Minister미너스터 of어^v브 the^ð디 Interior인티^r리어 and앤드 Safety세이^f프티 shall섈 notify노우터^f파이 the^ð더 head헤드 of어^v브 the^ð더 relevant^r렐러^v번트 receiving^r러시^v빙 agency,에이전시 the^ð더 head헤드 of어^v브 the^ð더 relevant^r렐러^v번트 supervising수퍼^v바이징 central센트^r럴 administrative어드미너스트^r레이티^v브 agency,에이전시 and앤드 the^ð더 Minister미너스터 of어^v브 Economy이카너미 and앤드 Finance^f퍼낸스 of어^v브 the^ð더 result^r리절트 of어^v브 deliberation딜리버^r레이션 by바이 the^ð더 Committee커미티 under언더 paragraphs패^r러그^r래^f프스 (4) and앤드 (5).

⑧ 해당 접수기관의 장은 제7항에 따른 심의 결과를 지체 없이 기탁자에게 알려야 한다. 이 경우 심의 결과 접수가 허용된 때에는 기탁물품을 접수하고 영수증을 발급하여야 한다.
