책임운영기관의 설치ㆍ운영에 관한 법률 제19조(임용시험)

① 소속책임운영기관 소속 공무원의 임용시험은 기관장이 실시한다. 다만, 기관장이 단독으로 실시하기 곤란한 경우에는 중앙행정기관의 장이 실시할 수 있으며, 다른 시험실시기관의 장과 공동으로 실시하거나 대통령령으로 정하는 다른 기관의 장에게 위탁하여 실시할 수 있다.

② 채용시험을 실시하는 경우에는 임용예정 직급(고위공무원단에 속하는 공무원으로 임명하는 직위의 경우에는 임용예정 직위를 말한다), 응시자격, 선발예정인원, 시험방법ㆍ시기 및 장소, 그 밖에 필요한 사항을 상당한 기간 공고하여야 한다. 다만, 경력직공무원의 공개경쟁 채용시험 외에는 경쟁의 원칙에 위배되지 아니하는 범위에서 대통령령으로 정하는 바에 따라 채용시험을 공고하지 아니할 수 있다.

③ 채용시험에 응시하기 위한 학력ㆍ경력ㆍ연령과 그 밖에 필요한 자격요건은 대통령령으로 정하고, 시험과목 및 시험방법에 관한 사항은 기본운영규정으로 정한다.
