책임운영기관의 설치ㆍ운영에 관한 법률 제27조(특별회계의 설치 등)

① 제4조제1항제2호의 사무를 주로 하는 소속책임운영기관의 사업을 효율적으로 운영하기 위하여 책임운영기관특별회계를 둔다. <개정 2011.3.8>

② 제1항에 따라 책임운영기관특별회계로 운영할 필요가 있는 소속책임운영기관은 재정수입 중 자체 수입의 비율 등 대통령령으로 정하는 기준에 따라 기획예산처장관이 재정경제부장관ㆍ행정안전부장관 및 해당 중앙행정기관의 장과 협의를 거쳐 정한다. <신설 2011.3.8, 2013.3.23, 2014.11.19, 2017.7.26, 2025.10.1>

③ 제2항에 따라 정하여진 소속책임운영기관(이하 "책임운영기관특별회계기관"이라 한다)을 제외한 소속책임운영기관은 일반회계로 운영하되, 대통령령으로 정하는 회계변경이 곤란한 특별한 사유가 있는 경우에는 다른 법률에 따라 설치된 특별회계로 운영할 수 있다. 이 경우 일반회계 또는 특별회계에 별도의 책임운영기관 항목을 설치하고 책임운영기관특별회계기관에 준하는 예산 운영상의 자율성을 보장하여야 한다. <개정 2011.3.8>

④ 제3항 후단에 따른 특별회계에 대하여는 제28조, 제29조, 제29조의2, 제30조, 제32조, 제33조 및 제35조부터 제38조까지의 규정을 적용하지 아니한다. <개정 2011.3.8>
