① 재생의료기관은 첨단재생의료 임상연구를 하기 전에 연구대상자로부터 다음 각 호의 사항이 포함된 동의서에 서명을 받아야 한다.

② 제1항에도 불구하고 연구대상자가 미성년자인 경우에는 본인과 그 부모(부모가 없는 경우에는 법정대리인을 말한다)의 동의를 함께 받아야 하고, 본인이 동의 능력이 없거나 불완전한 사람인 경우에는 다음 각 호에서 정한 대리인의 서면동의를 받아야 한다. 이 경우 대리인의 동의는 연구대상자의 의사에 어긋나서는 아니 된다.

③ 재생의료기관은 제1항에 따른 동의를 받기 전에 연구대상자에게 제1항 각 호의 사항에 대하여 충분히 설명하여야 한다.

④ 재생의료기관은 연구대상자에게 발생할 수 있는 건강상의 피해를 배상 또는 보상하기 위하여 보험에 가입하고, 피해 발생으로 보상하는 경우에는 연구대상자에게 사전에 설명한 보상 절차 등을 준수하여야 한다.
