초ㆍ중등교육법 제60조의8(조사ㆍ질문)

① 교육부장관 및 교육감은 제60조의6에 따라 교육비 지원을 신청한 사람(이하 "교육비신청자"라 한다) 또는 지원이 확정된 자에게 교육비 지원 대상 자격확인을 위하여 필요한 서류나 그 밖의 소득 및 재산 등에 관한 자료의 제출을 요구할 수 있으며, 지원 대상 자격확인을 위하여 필요한 자료를 확보하기 곤란하거나 제출한 자료가 거짓 등의 자료라고 판단하는 경우 소속 공무원으로 하여금 관계인에게 필요한 질문을 하게 하거나, 교육비신청자 및 지원이 확정된 자의 동의를 받아 주거 또는 그 밖의 필요한 장소에 출입하여 서류 등을 조사하게 할 수 있다. <개정 2013.3.23, 2016.2.3, 2025.3.18>

② 교육부장관 및 교육감은 제1항에 따른 업무를 수행하기 위하여 필요한 국세ㆍ지방세, 토지ㆍ건물 또는 건강보험ㆍ국민연금ㆍ고용보험ㆍ산업재해보상보험ㆍ가족관계증명 등에 관한 자료의 제공을 관계 기관의 장에게 요청할 수 있다. 이 경우 관계 기관의 장은 특별한 사유가 없으면 이에 따라야 한다. <개정 2013.3.23>

③ 제1항에 따라 출입ㆍ조사 또는 질문을 하는 사람은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 내보여야 한다.

④ 교육부장관 및 교육감은 교육비신청자 또는 지원이 확정된 자가 제1항에 따른 서류 또는 자료의 제출을 거부하거나 조사 또는 질문을 거부ㆍ방해 또는 기피하는 경우에는 제60조의6제1항에 따른 교육비 지원의 신청을 각하하거나 지원결정을 취소ㆍ중지 또는 변경할 수 있다. <개정 2013.3.23, 2025.3.18>
