재판장은 특정강력범죄로 공소제기된 피고인이 폭력을 행사하거나 도망할 염려가 있다고 인정할 때에는 공판정에서 피고인의 신체를 구속할 것을 명하거나 그 밖에 필요한 조치를 할 수 있다.
