River Act, Article 10 (Determination of River Zones)
①하천관리청은 제7조제6항에 따라 하천의 명칭 및 구간의 지정 또는 지정의 변경ㆍ해제의 고시가 있는 때에는 다음 각 호의 어느 하나에 해당하는 지역을 하천구역으로 결정 또는 변경하거나 하천구역을 폐지하여야 한다. <개정 2020.6.9>
(1) Where there is a public notice of the designation of a river's name and section, or of a change or revocation of designation, under Article 7 (6), the river administrator shall determine or change as a river zone, or abolish the river zone for, an area falling under any of the following:
1. 제25조에 따른 하천기본계획(이하 "하천기본계획"이라 한다)에 완성제방(하천시설의 설치계획을 수립할 때에 기준이 되는 홍수량만큼의 물이 소통하는데 필요한 단면을 가지고 있어서 구조적 안정성이 이미 확보된 제방을 말한다)이 있는 곳은 그 완성제방의 부지 및 그 완성제방으로부터 하심측(河心側)의 토지
1. Where there is a completed levee in the basic river plan under Article 25 (hereinafter referred to as the "basic river plan") (meaning a levee that has a cross-section necessary for conveying the flood discharge used as the standard when formulating plans for installing river facilities, and whose structural stability has already been secured), the site of that completed levee and the land on the river-center side of that completed levee;
2. 하천기본계획에 계획제방(제방을 보강하거나 새로이 축조하도록 계획된 제방을 말한다)이 있는 곳은 그 계획제방의 부지 및 그 계획제방으로부터 하심측의 토지
2. Where there is a planned levee in the basic river plan (meaning a levee planned to be reinforced or newly built), the site of that planned levee and the land on the river-center side of that planned levee;
3. 하천기본계획에 제방의 설치계획이 없는 구간에서는 계획하폭(하천시설의 설치계획을 수립할 때에 기준이 되는 홍수량만큼의 물이 소통하는데 필요한 양안 사이의 폭을 말한다)에 해당하는 토지
3. In a section where the basic river plan has no plan for installing a levee, land corresponding to the planned river width (meaning the width between both banks necessary for conveying the flood discharge used as the standard when formulating plans for installing river facilities);
4. 댐ㆍ하구둑ㆍ홍수조절지ㆍ저류지의 계획홍수위(하천시설의 설치계획을 수립할 때에 기준이 되는 홍수량만큼의 물이 소통하는 경우 그 수위를 말한다. 이하 같다) 아래에 해당하는 토지
4. Land below the planned flood level (meaning the water level when the flood discharge used as the standard when formulating plans for installing river facilities flows; hereinafter the same applies) of a dam, estuary barrage, flood control reservoir, or retention basin;
5. 철도ㆍ도로 등 선형 공작물이 제방의 역할을 하는 곳에서는 선형 공작물의 하천측 비탈머리를 제방의 비탈머리로 보아 그로부터 하심측에 해당하는 토지
5. Where a linear structure such as a railway or road serves as a levee, the toe of the slope on the river side of the linear structure is regarded as the toe of the levee slope, and land on the river-center side of it; and
6. 하천기본계획이 수립되지 아니한 하천에서는 하천에 물이 계속하여 흐르고 있는 토지 및 지형, 그 토지 주변에서 풀과 나무가 자라는 지형의 상황, 홍수흔적, 그 밖의 상황을 기초로 대통령령으로 정하는 방법에 따라 평균하여 매년 1회 이상 물이 흐를 것으로 판단되는 수면 아래에 있는 토지
6. For a river for which no basic river plan has been formulated, land under the water surface where water is judged to flow, on average, at least once a year, by a method prescribed by Presidential Decree, based on the land where water continuously flows in the river, the topography, the condition of terrain around the land where grass and trees grow, flood traces, and other conditions.
②하천관리청이 제1항에 따라 하천구역을 결정하려는 때에는 국가수자원관리위원회 또는 지역수자원관리위원회(이하 "수자원관리위원회"라 한다)의 심의를 거쳐야 한다. 하천구역을 변경 또는 폐지하려는 때에도 또한 같다. <개정 2017.1.17>
(2) When intending to determine a river zone under paragraph (1), the river administrator shall undergo deliberation by the National Water Resources Management Committee or the Regional Water Resources Management Committee (hereinafter referred to as the "Water Resources Management Committee"). The same applies when changing or abolishing a river zone.
③제7조제6항은 제1항에 따른 하천구역의 결정ㆍ변경 및 폐지에 관하여 준용한다. 이 경우 하천관리청은 하천구역의 결정ㆍ변경 또는 폐지의 사실 및 그 내용을 해당 지역을 주된 보급지역으로 하는 일간신문 및 해당 기관과 관계 시ㆍ군ㆍ구(자치구를 말한다. 이하 같다)의 인터넷 홈페이지에 공고하도록 하여야 한다. <개정 2023.1.3>
(3) Article 7 (6) applies mutatis mutandis to the determination, change, and abolition of a river zone under paragraph (1). In such cases, the river administrator shall post a public notice of the fact and contents of the determination, change, or abolition of the river zone in a daily newspaper mainly distributed in the relevant area and on the internet websites of the relevant agency and the relevant Si, Gun, or Gu (meaning an autonomous Gu; hereinafter the same applies).
④ 하천관리청은 제1항에 따라 하천구역을 결정ㆍ변경 또는 폐지하려는 경우 지역주민 등의 의견을 청취하여야 하며, 제3항에 따라 하천구역의 결정ㆍ변경 또는 폐지의 고시를 하는 때에는 기후에너지환경부령으로 정하는 바에 따라 지형도면을 작성하여 함께 고시하여야 한다. <개정 2018.2.21, 2020.12.31, 2025.10.1>
(4) When intending to determine, change, or abolish a river zone under paragraph (1), the river administrator shall hear the opinions of local residents, etc., and when publicly notifying the determination, change, or abolition of the river zone under paragraph (3), shall prepare and publicly notify together a topographic map, as prescribed by Ordinance of the Ministry of Climate, Energy and Environment.
⑤하천구역의 결정ㆍ변경 또는 폐지는 제3항에 따른 고시가 있는 날부터 그 효력이 발생한다.
(5) The determination, change, or abolition of a river zone takes effect from the date of the public notice under paragraph (3).
⑥국가 및 지방자치단체는 제1항에 따라 하천구역으로 된 때에는 국가하천인 경우 「국유재산법」에 따른 국유재산으로, 지방하천인 경우 「공유재산 및 물품 관리법」에 따른 공유재산으로 확보되도록 노력하여야 한다.
(6) When land becomes a river zone under paragraph (1), the State and local governments shall endeavor to secure it as State property under the State Property Act in the case of a national river, and as public property under the Public Property and Commodity Management Act in the case of a local river.
