하천법 제26조(하천시설의 비상대처계획)

①댐 등 대통령령으로 정하는 하천시설을 설치하는 자는 하천시설의 붕괴 등의 비상상황으로 발생할 수 있는 국민의 생명ㆍ재산상 피해를 예방하거나 줄이기 위한 비상대처계획을 수립하여야 한다. 다만, 다른 법률에 따라 비상대처계획을 수립하는 경우에는 그러하지 아니하다.

②제1항에 따라 비상대처계획을 수립하려는 때에는 미리 관계 행정기관의 장과 협의하여야 하며, 비상대처계획을 수립한 때에는 지체 없이 관계 행정기관의 장에게 수립된 비상대처계획을 통지하여야 한다. 이 경우 그 통지를 받은 관계 행정기관의 장은 비상대처계획에 따른 대처에 필요한 조치를 하여야 한다.

③제2항은 수립된 비상대처계획의 변경에 관하여 준용한다.

④비상대처계획에 포함되어야 하는 사항, 그 밖에 비상대처계획의 수립에 관한 세부적인 사항은 대통령령으로 정한다.
