한국주택금융공사법 시행령 제37조의2(고유식별정보의 처리)
Enforcement Decree of the Korea Housing Finance Corporation Act, Article 37-2 (Processing of Personally Identifiable Information)
금융위원회(법 제61조제2항 및 이 영 제37조에 따라 금융위원회의 업무를 위탁받은 자를 포함한다), 공사(법 제45조 및 이 영 제31조에 따라 공사의 업무를 위탁받은 자를 포함한다)는 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조에 따른 주민등록번호, 여권번호, 운전면허의 면허번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2020.3.31, 2022.6.7, 2023.8.31>
Where unavoidable to perform the following duties, the Financial Services Commission (including a person entrusted with the Commission's work under Article 61 (2) of the Act and Article 37 of this Decree) and the Corporation (including a person entrusted with the Corporation's work under Article 45 of the Act and Article 31 of this Decree) may process data including resident registration numbers, passport numbers, driver's license numbers, or foreigner registration numbers under Article 19 of the Enforcement Decree of the Personal Information Protection Act:
1. 법 제22조제1항제1호ㆍ제2호, 제22조의2, 제23조부터 제25조까지(법 제46조제2항에서 준용하는 경우를 포함한다), 제27조, 제29조ㆍ제30조(법 제46조제2항에서 준용하는 경우를 포함한다) 및 제36조제1항제1호에 따른 채권유동화 및 채권보유 등에 관한 사무
1. Duties concerning claim securitization and claim holding, etc. under Article 22 (1) 1 and 2, Article 22-2, Articles 23 through 25 (including cases applied mutatis mutandis under Article 46 (2) of the Act), Article 27, Articles 29 and 30 (including cases applied mutatis mutandis under Article 46 (2) of the Act), and Article 36 (1) 1 of the Act;
2. 법 제22조제1항제5호에 따른 주택저당채권 또는 학자금대출채권에 대한 평가 및 실사에 관한 사무
2. Duties concerning evaluation of and due diligence on housing mortgage claims or student loan claims under Article 22 (1) 5 of the Act;
3. 법 제22조제1항제7호 및 제37조에 따른 신용보증에 관한 사무(제3조제4호에 따른 보증사무의 경우 임대인의 정보를, 제3조제5호에 따른 보증사무의 경우 임차인의 정보를 각각 포함한다)
3. Duties concerning credit guarantees under Article 22 (1) 7 and Article 37 of the Act (including information on the lessor in the case of guarantee duties under Article 3 4 of this Decree and information on the lessee in the case of guarantee duties under Article 3 5);
4. 법 제22조제1항제8호, 제38조 및 제39조에 따른 신용보증채무의 이행 및 구상권의 행사에 관한 사무(제3조제4호에 따른 보증사무의 경우 임대인의 정보를, 제3조제5호에 따른 보증사무의 경우 임차인의 정보를 각각 포함한다)
4. Duties concerning performance of credit guarantee obligations and exercise of the right of reimbursement under Article 22 (1) 8 and Articles 38 and 39 of the Act (including information on the lessor in the case of guarantee duties under Article 3 4 of this Decree and information on the lessee in the case of guarantee duties under Article 3 5);
5. 법 제22조제1항제9호, 제43조의2에 따른 주택담보노후연금보증에 관한 사무
5. Duties concerning housing-secured retirement pension guarantees under Article 22 (1) 9 and Article 43-2 of the Act;
6. 법 제22조제1항제10호, 제43조의3, 제43조의4, 제43조의10에 따른 주택담보노후연금보증채무의 이행 및 구상권의 행사에 관한 사무
6. Duties concerning performance of housing-secured retirement pension guarantee obligations and exercise of the right of reimbursement under Article 22 (1) 10 and Articles 43-3, 43-4, and 43-10 of the Act;
7. 법 제22조제1항제11호, 제43조의5에 따른 주택담보노후연금채권의 양수 및 보유, 주택담보노후연금의 지급 등에 관한 사무
7. Duties concerning acquisition and holding of housing-secured retirement pension claims and payment of housing-secured retirement pensions under Article 22 (1) 11 and Article 43-5 of the Act;
8. 법 제22조제1항제12호에 따른 신용조사 및 신용정보의 종합관리에 관한 사무
8. Duties concerning credit investigation and comprehensive management of credit information under Article 22 (1) 12 of the Act;
9. 법 제22조제1항제13호에 따른 주택금융에 관한 조사ㆍ연구 및 통계자료의 수집ㆍ작성에 관한 사무
9. Duties concerning research on housing finance and collection and compilation of statistical data under Article 22 (1) 13 of the Act;
10. 법 제22조제1항제1호ㆍ제2호ㆍ제5호 및 제7호부터 제13호까지의 규정에 따른 업무에 딸린 업무로서 금융위원회의 승인을 받은 업무에 관한 사무
10. Duties incidental to the work under Article 22 (1) 1, 2, 5, and 7 through 13 of the Act that have been approved by the Financial Services Commission;
11. 법 제45조제1항(법 제46조제2항에서 준용하는 경우를 포함한다)에 따른 주택저당채권의 관리ㆍ운용 및 처분에 관한 사무
11. Duties concerning management, operation, and disposition of housing mortgage claims under Article 45 (1) of the Act (including cases applied mutatis mutandis under Article 46 (2) of the Act);
12. 법 제46조제1항에 따른 학자금대출증권의 발행에 관한 사무
12. Duties concerning issuance of student loan securities under Article 46 (1) of the Act;
13. 법 제60조에 따른 감독에 관한 사무
13. Duties concerning supervision under Article 60 of the Act;
14. 법 제61조에 따른 보고서 제출 및 서류의 검사에 관한 사무
14. Duties concerning submission of reports and inspection of documents under Article 61 of the Act;
15. 법 제64조, 제64조의2 및 제64조의3에 따른 자료제공의 요청에 관한 사무
15. Duties concerning requests for provision of data under Articles 64, 64-2, and 64-3 of the Act.
