한국주택금융공사법 제43조의7(저당권 설정 등의 제한)

① 주택담보노후연금보증을 받은 사람은 담보주택에 대하여 채권 확보에 지장이 없는 경우로서 대통령령으로 정하는 경우를 제외하고는 다음 각 호의 행위를 하여서는 아니 된다.

② 주택담보노후연금보증을 받은 사람은 공사의 동의 없이는 제한물권을 설정하거나 압류ㆍ가압류ㆍ가처분 및 임대차 등의 목적물이 될 수 없는 재산임을 담보주택의 소유권등기에 부기등기(附記登記)하여야 한다. 이 경우 부기등기의 시기ㆍ내용 및 말소에 관한 사항은 대통령령으로 정한다.

③ 제2항에 따른 부기등기일 이후에 담보주택에 제한물권이 설정된 경우 또는 담보주택이 압류ㆍ가압류ㆍ가처분ㆍ임대차 등의 목적물로 된 경우에는 그 효력을 무효로 한다.

④ 제2항에도 불구하고 제22조제1항제9호의2의 업무를 수행하는 경우에는 소유권등기에 부기등기하지 아니할 수 있다. <신설 2020.12.8>
