항만시설관리권 등록령 제53조(일부분할의 등록)

① 갑 항만시설관리권을 분할하여 그 일부를 을 항만시설관리권으로 한 경우에 분할의 등록을 하는 때에는 등록용지 중 등록번호란에 번호를 적고, 표시란에 분할로 인하여 몇호의 항만시설관리권 등록용지로부터 옮겨 적은 뜻을 적어야 한다.

② 제1항에 따라 옮겨 적은 경우에는 갑 항만시설관리권의 등록용지 중 표시란에 남은 부분의 표시를 하고 분할로 인하여 다른 부분을 몇호의 항만시설관리권의 등록용지에 옮겨 적은 뜻을 적은 후 종전의 표시와 그 번호를 붉은 선으로 지워야 한다.

③ 제1항의 경우에는 을 항만시설관리권의 등록용지 중 해당구 사항란에 갑 항만시설관리권의 등록용지로부터 항만시설관리권 또는 저당권에 관한 등록을 복사하고, 저당권에 관한 등록에 갑 항만시설관리권과 같이 그 권리의 목적이 된다는 뜻, 신청서 접수연월일과 접수번호를 적은 후 등록공무원이 도장을 찍어야 한다.

④ 갑 항만시설관리권의 등록용지로부터 을 항만시설관리권의 등록용지에 저당권에 관한 등록을 복사한 경우에는 갑 항만시설관리권의 등록용지 중 그 권리에 관한 등록에 을 항만시설관리권과 같이 그 권리의 목적이 된다는 뜻을 부기하여야 한다.

⑤ 신청서에 저당권의 등록명의인이 을 항만시설관리권에 관하여 그 권리의 소멸을 승낙한 것을 증명하는 서류 또는 이에 대항할 수 있는 재판의 등본을 첨부한 경우에는 갑 항만시설관리권의 등록용지 중 해당 권리에 관한 등록에 그 뜻을 부기하여야 한다.
