형사소송법 제141조(신체검사에 관한 주의)

① 신체의 검사에 관하여는 검사를 받는 사람의 성별, 나이, 건강상태, 그 밖의 사정을 고려하여 그 사람의 건강과 명예를 해하지 아니하도록 주의하여야 한다.

② 피고인 아닌 사람의 신체검사는 증거가 될 만한 흔적을 확인할 수 있는 현저한 사유가 있는 경우에만 할 수 있다.

③ 여자의 신체를 검사하는 경우에는 의사나 성년 여자를 참여하게 하여야 한다.

④ 시체의 해부 또는 분묘의 발굴을 하는 때에는 예(禮)에 어긋나지 아니하도록 주의하고 미리 유족에게 통지하여야 한다.
