형사소송법 제392조(공동피고인을 위한 파기)

피고인의 이익을 위하여 원심판결을 파기하는 경우에 파기의 이유가 상고한 공동피고인에 공통되는 때에는 그 공동피고인에 대하여도 원심판결을 파기하여야 한다.
