형사소송법 제411조(소송기록등의 송부)

①원심법원이 필요하다고 인정한 때에는 소송기록과 증거물을 항고법원에 송부하여야 한다.

③전2항의 경우에 항고법원이 소송기록과 증거물의 송부를 받은 날로부터 5일 이내에 당사자에게 그 사유를 통지하여야 한다.
