형사소송법 제469조(사형 집행의 정지)

① 사형선고를 받은 사람이 심신의 장애로 의사능력이 없는 상태이거나 임신 중인 여자인 때에는 법무부장관의 명령으로 집행을 정지한다.

② 제1항에 따라 형의 집행을 정지한 경우에는 심신장애의 회복 또는 출산 후에 법무부장관의 명령에 의하여 형을 집행한다.
