Enforcement Rule of the Act on the Execution of Sentences and the Treatment of Inmates, Article 205 (Designation and Cancellation)
① 소장은 제204조 각 호의 어느 하나에 해당하는 수용자에 대하여는 마약류수용자로 지정하여야 한다. 현재의 수용생활 중 집행되었거나 집행할 형이 제204조제1호에 해당하는 경우에도 또한 같다.
(1) The warden shall designate inmates falling under any of the subparagraphs of Article 204 as narcotics inmates. The same shall apply where a sentence that has been executed or is to be executed during the current life in custody falls under Article 204 1.
② 소장은 제1항에 따라 마약류수용자로 지정된 사람에 대하여는 석방할 때까지 지정을 해제할 수 없다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 교도관회의의 심의 또는 분류처우위원회의 의결을 거쳐 지정을 해제할 수 있다. <개정 2014.11.17, 2026.2.5>
(2) The warden shall not cancel the designation of a person designated as a narcotics inmate under paragraph (1) until release: Provided, That in any of the following cases, the designation may be cancelled after deliberation by the correctional officers' meeting or resolution by the Classification and Treatment Committee:
1. 공소장 변경 또는 재판 확정에 따라 지정사유가 해소되었다고 인정되는 경우
1. Where it is deemed that the grounds for designation have been resolved due to an amendment of the indictment or the finalization of a judgment;
2. 지정 후 5년이 지난 마약류수용자로서 수용생활태도, 교정성적 등이 양호한 경우
2. Where the narcotics inmate has passed five years since designation and his or her attitude in life in custody, correctional performance, etc. are good;
3. 제204조제2호에 따라 지정된 마약류수용자 중 마약류에 관한 형사 법률을 적용받은 형의 집행유예 기간이 지난 경우
3. Where the period of suspension of execution of the sentence to which criminal Acts concerning narcotics were applied has passed for a narcotics inmate designated under Article 204 2.
