형의 집행 및 수용자의 처우에 관한 법률 시행규칙 제249조(사전조사 시기 등)

① 제246조제1호의 사항에 대한 조사는 수형자를 수용한 날부터 1개월 이내에 하고, 그 후 변경할 필요가 있는 사항이 발견되거나 가석방 적격심사신청을 위하여 필요한 경우에 한다. <개정 2010.5.31>

② 제246조제2호의 사항에 대한 조사는 수형자를 수용한 날부터 2개월 이내에 하고, 조사에 필요하다고 인정하는 경우에는 소송기록을 열람할 수 있다.

③ 제246조제3호의 사항에 대한 조사는 형기의 3분의 1이 지나기 전에 하여야 하고, 그 후 변경된 사항이 있는 경우에는 지체 없이 그 내용을 변경하여야 한다.
