30개월 이상 복무한 상등병 만기전역자의 특별진급을 위한 특별법 제8조(특별진급의 결정 및 통보)

① 복무 기관장은 제6조에 따른 신청을 받은 날부터 120일 이내에 특별진급 여부를 결정하여야 한다. 다만, 복무 기관장은 사실조사 등을 위하여 필요한 경우에는 30일의 범위에서 그 기간을 연장할 수 있다.

② 제1항에 따른 특별진급 결정에 따라 상등병 만기전역자를 특별진급시키는 경우에는 그 전역일을 진급 발령일로 하여 특별진급한 것으로 본다.

③ 복무 기관장은 제7조에 따른 사실조사 결과 상등병 만기전역자가 복무 당시 병장으로 진급할 수 없는 사유에 해당하는 징계처분이나 형사처벌을 받은 경우 등 대통령령으로 정하는 요건에 해당하는 경우에는 특별진급을 제한할 수 있다.

④ 복무 기관장은 제1항에 따라 특별진급 여부를 결정한 경우 제6조에 따라 특별진급을 신청한 상등병 만기전역자와 그 유족(이하 "신청인"이라 한다)에게 결과와 이유를 서면으로 통보하여야 한다.

⑤ 제4항에 따른 통보 절차와 그 밖에 특별진급의 결정 및 통보에 필요한 사항은 대통령령으로 정한다.
