간척지의 농어업적 이용 및 관리에 관한 법률 제15조(토지에의 출입 등에 따른 손실보상)

① 제14조에 따른 행위로 인하여 손실을 받은 자가 있는 때에는 사업시행자가 그 손실을 보상하여야 한다.

② 제1항에 따른 손실보상에 관하여는 사업시행자와 손실을 받은 자가 협의하여야 한다.

③ 사업시행자 또는 손실을 받은 자는 제2항에 따른 협의가 성립되지 아니하거나 협의를 할 수 없는 경우에는 토지ㆍ물건 등에 관하여 관할 토지수용위원회에 재결을 신청할 수 있다. 이 경우 재결의 신청은 「공익사업을 위한 토지 등의 취득 및 보상에 관한 법률」 제23조제1항 및 같은 법 제28조제1항에도 불구하고 해당 간척지활용사업의 시행기간 내에 할 수 있다.

④ 제3항에도 불구하고 「수산업법」 제7조에 따른 면허어업, 같은 법 제40조에 따른 허가어업 및 같은 법 제48조에 따른 신고어업에 관한 권리에 관하여는 같은 법 제88조부터 제94조까지의 규정에 따른 보상규정을 적용하고, 「양식산업발전법」 제10조 및 제43조에 따른 양식업에 관한 권리에 관하여는 같은 법 제67조부터 제69조까지의 규정에 따른 보상 규정을 적용한다. <개정 2019.8.27, 2022.1.11>
