건설폐기물의 재활용촉진에 관한 법률 제17조(배출자의 신고 등)

① 배출자는 해당 건설공사에서 발생할 건설폐기물의 종류별 발생예상량을 조사하여 그 결과를 토대로 폐기물 처리계획서를 작성하여 특별자치시장ㆍ특별자치도지사 또는 시장ㆍ군수ㆍ구청장에게 신고하여야 한다. 신고한 사항을 변경할 때에도 또한 같다. <개정 2013.6.12>

② 제1항에 따른 폐기물 처리계획서에는 다음 각 호의 사항이 포함되어야 한다. <개정 2025.10.1>

③ 특별자치시장ㆍ특별자치도지사 또는 시장ㆍ군수ㆍ구청장은 제1항에 따른 신고 또는 변경신고를 받은 날부터 10일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2023.3.28>

④ 특별자치시장ㆍ특별자치도지사 또는 시장ㆍ군수ㆍ구청장이 제3항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2023.3.28>
