공공단체등 위탁선거에 관한 법률 제35조(기부행위제한)

① 후보자(후보자가 되려는 사람을 포함한다. 이하 이 조에서 같다), 후보자의 배우자, 후보자가 속한 기관ㆍ단체ㆍ시설은 기부행위제한기간 중 기부행위를 할 수 없다.

② 누구든지 기부행위제한기간 중 해당 위탁선거에 관하여 후보자를 위하여 기부행위를 하거나 하게 할 수 없다. 이 경우 후보자의 명의를 밝혀 기부행위를 하거나 후보자가 기부하는 것으로 추정할 수 있는 방법으로 기부행위를 하는 것은 해당 위탁선거에 관하여 후보자를 위한 기부행위로 본다.

③ 누구든지 기부행위제한기간 중 해당 위탁선거에 관하여 제1항 또는 제2항에 규정된 자로부터 기부를 받거나 기부의 의사표시를 승낙할 수 없다.

④ 누구든지 제1항부터 제3항까지 규정된 행위에 관하여 지시ㆍ권유ㆍ알선 또는 요구할 수 없다.

⑤ 「농업협동조합법」, 「수산업협동조합법」 및 「산림조합법」에 따른 조합장ㆍ중앙회장과 「새마을금고법」 및 「신용협동조합법」에 따른 이사장ㆍ중앙회장은 재임 중에 기부행위를 할 수 없다. <개정 2023.3.2, 2023.8.8, 2025.8.14>
