공공주택 특별법 제48조의2(공공분양주택 분양가심사위원회의 설치 등)

① 주택지구 전체 개발면적의 100분의 50 이상을 「개발제한구역의 지정 및 관리에 관한 특별조치법」 제3조에 따라 개발제한구역을 해제하여 조성하는 주택지구에서 제4조제4호 또는 제6호에 해당하는 자가 건설하여 공급하는 공공주택의 분양가에 관한 사항을 심의하기 위하여「주택법」 제59조에도 불구하고 제4조제1호부터 제4호까지의 규정 중 어느 하나에 해당하는 자가 분양가심사위원회를 설치ㆍ운영하여야 한다. <개정 2014.1.14, 2014.12.31, 2016.1.19>

② 시장ㆍ군수ㆍ구청장은 「주택법」 제54조제1항제1호에 따라 공공주택의 입주자모집승인을 할 때에는 분양가심사위원회의 심사결과에 따라 승인 여부를 결정하여야 한다. <개정 2014.1.14, 2016.1.19>
