공무원보수규정 제12조(강임ㆍ강등 시의 호봉 획정)

① 일반직공무원, 공안업무 등에 종사하는 공무원, 연구직공무원, 지도직공무원 또는 경찰ㆍ소방공무원 등(별표 3, 별표 4부터 별표 6까지, 별표 8 또는 별표 10의 봉급표를 적용받는 공무원을 말한다)이 강임되는 경우에는 강임된 계급에서의 호봉을 획정한다. <개정 2014.7.16>

② 강임된 계급에서의 호봉 획정은 별표 28에서 정하는 승진 후 호봉을 강임되기 전의 계급의 호봉으로 보고 이에 해당하는 승진 전 호봉을 강임되는 계급의 호봉으로 획정한다. 이 경우 강임되는 계급에서 획정되는 호봉이 2개 이상이면 그 중 가장 높은 호봉으로 획정한다.

③ 제2항에 따라 강임된 계급에서의 호봉을 획정할 때 강임되는 공무원이 강임일 현재 강임 전의 계급에서 호봉에 반영되지 아니한 잔여기간이 12개월 이상인 경우에는 제13조에도 불구하고 강임일에 강임 전의 계급에서 승급시킨 후에, 강임된 계급에서의 호봉을 획정한다. 이 경우 승급발령은 하지 아니하며 강임된 계급에서의 호봉 획정으로 갈음한다.

④ 강임되기 전 계급에서의 호봉에 반영되지 아니한 잔여기간(제3항이 적용되는 경우에는 승급시킨 후의 잔여기간을 말한다)은 강임된 계급에서의 다음 승급기간에 산입한다.

⑤ 제1항의 공무원이 강등되는 경우의 호봉 획정에 관하여는 제1항부터 제4항까지의 규정을 준용한다. 이 경우 "강임"은 "강등"으로 본다.
