공유수면 관리 및 매립에 관한 법률 제43조(공유수면매립 권리ㆍ의무의 양도 등)

① 매립면허로 인하여 발생한 권리ㆍ의무는 대통령령으로 정하는 바에 따라 이전하거나 상속할 수 있다.

(1) Rights^r라잇츠 and앤드 obligations아블러게이션즈 arising어^r라이징 from^f프^r럼 a어 reclamation^r레클러메이션 license라이슨스 may메이 be비 transferred트^r랜스^f퍼드 or오 inherited,인헤^r러티드 as애즈 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree.디크^r리

② 제1항에 따라 권리ㆍ의무를 이전받거나 상속받은 자는 해양수산부령으로 정하는 바에 따라 권리ㆍ의무의 이전 또는 상속 내용을 매립면허관청에 신고하여야 한다. <개정 2013.3.23>

(2) A어 person퍼슨 to투 whom훔 rights^r라잇츠 and앤드 obligations아블러게이션즈 have해^v브 been빈 transferred트^r랜스^f퍼드 or오 inherited인헤^r러티드 under언더 paragraph패^r러그^r래^f프 (1) shall섈 report^r리포트 the^ð더 transfer트^r랜스^f퍼 or오 inheritance인헤^r러튼스 of어^v브 rights^r라잇츠 and앤드 obligations아블러게이션즈 to투 the^ð더 reclamation^r레클러메이션 licensing라이선싱 authority,어^θ쏘^r러티 as애즈 prescribed프^r리스크^r라이브드 by바이 Ordinance오더넌스 of어^v브 the^ð더 Ministry미너스트^r리 of어^v브 Oceans오우션즈 and앤드 Fisheries.^f피셔^r리즈

③ 매립면허관청은 제2항에 따른 신고를 받은 날부터 10일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2019.8.20>

④ 매립면허관청이 제3항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2019.8.20>

⑤ 제1항 및 제2항에 따른 면허에 관한 권리ㆍ의무를 이전하거나 승계하는 경우 그 권리ㆍ의무를 분할하여서는 아니 된다. <개정 2019.8.20>

(5) When웬 transferring트^r랜스^f퍼^r링 or오 succeeding석시딩 to투 rights^r라잇츠 and앤드 obligations아블러게이션즈 concerning컨서닝 a어 license라이슨스 under언더 paragraphs패^r러그^r래^f프스 (1) and앤드 (2), those^ð도우즈 rights^r라잇츠 and앤드 obligations아블러게이션즈 may메이 not낫 be비 divided.디^v바이디드

⑥ 제3항에 따라 권리ㆍ의무의 이전 또는 상속의 신고가 수리된 자(제4항에 따라 신고수리가 된 것으로 보는 자를 포함한다)는 이 법에 따른 매립면허취득자로 본다. <개정 2019.8.20>
